These general terms and conditions apply to the website and services of Rosenlunds Musik Centrum (hereinafter often referred to as "we" or "us").

1. GENERAL

1.1 These general terms and conditions form an integral part of the agreement and apply to all offers made by Rosenlunds Musik Centrum. They apply to all services provided by Rosenlunds Musik Centrum, its partners, employees, or other individuals collaborating with it or for whom it is liable. Rosenlunds Musik Centrum may consider anyone who has entrusted it with an assignment as its client, bound in its own name. Deviations from these general terms and conditions can only be made in writing and must be approved in advance by Elisabeth Moser of Rosenlunds Musik Centrum. The terms and conditions are accessible to everyone and are included on the website of Rosenlunds Musik Centrum. Upon request, we will send you a written copy.

1.2 By signing up for music lessons, workshops, or visiting concerts, you indicate that you agree to the payment, and all other conditions mentioned here. Rosenlunds Musik Centrum reserves the right to amend its general terms and conditions.

1.3 Unless explicitly agreed upon in writing, we do not recognize the general or specific terms or conditions of third parties.

1.4 We guarantee that the delivered product complies with the agreement and meets the specifications stated in the offer.

2. DELIVERY

2.1 For 1:1 lessons it will be agreed on a specific point of time which is the same for group- and Online-lessons. All workshops at Rosenlunds Musik Centrum have a specific date announced. Concerts are announced with exact dates and times.

2.2 In case of that a planned lesson cannot be held/attended, Rosenlunds Musik Centrum would appreciate notification at least 1 day before. In this case that Rosenlunds Musik Centrum cannot hold the agreed lesson, the consumer will be notified at least 1 day before and a new date and time will be found together.

In case of cancellation of a workshop all signed-up participants will be informed at least 1 day before and a new date will be found.

In case of cancellation of a concert, Rosenlunds Musik Centrum will inform via rosenlundsmusikcentrum.com, social media channels, and email.

2.3 Our services will be considered fulfilled once the agreed services have been utilized: The visit to a concert until it is over, participating in a workshop until it has been closed, or attending a lesson group lesson until it is over.

Especially regarding lessons on an instrument that is directly associated with a specific progress, aims will be defined beforehand.

3. PRICES

3.1 Services such workshops are generally invoiced in advance after signing up for the specific session which is also the same for instrumental lessons-packages. For single and group lessons the payment has to be made within 14 days after receiving the invoice. Rosenlunds Musik Centrum holds concerts that have a specific entrance price and others where people can pay a voluntary amount. Regarding concerts with specific entrance price payment terms can be found on the announcement for the specific event. All prices are in SEK

The prices mentioned by Rosenlunds Musik Centrum are always inclusive of VAT. All invoices are payable within 14 days unless otherwise stated. Any protest against an invoice must be made in writing, with reasons, and by registered mail within ten days of the invoice date. If any of these conditions are not met, the protest will be considered non-existent, and the invoice will be deemed definitively accepted by Rosenlunds Musik Centrum without the need for a response to the protest. Received payments will first be applied to overdue interest and damages, then to the principal amount of the oldest due invoice. Non-payment on the due date automatically and without notice entails an interest of 10% per annum for the customer. The bottom line is, that a customer who does not pay for an already-used service, cannot book any other services from Rosenlund Musik Centrum.

3.2 Regarding signing up for workshops or lessons through the website: prices will not be increased during the duration of the offer.

3.3 The proposals and price lists of Rosenlunds Musik Centrum on the website www.rosenlundsmusikcentrum.com are informative. The prices that are ultimately applicable to the services ordered by the customer (custom offers) will be communicated personally by Rosenlunds Musik Centrum to the customer and are valid for a period of 14 days.

3.4 All prices on the site are subject to typographical and typesetting errors. No liability is accepted for the consequences of typographical and typesetting errors.

3.5 All prices on the site are in SEK and inclusive of 25% VAT.

4. REFLECTION PERIOD / RIGHT OF WITHDRAWAL

4.2 The right of withdrawal only applies to the delivered services. Withdrawal from signed-up workshops can be made until 1 day before the specific date. Withdrawal from an agreed lessons package before the first lesson has taken place can be made 1 day before the first session. Once the first lesson has started a withdrawal from the lessons-package can be done in combination with a discussion with Rosenlunds Musik Centrum. In any case, the withdrawal has to be ground on a solid reason which has to be discussed.

Withdrawal from concerts with a specific entry price can be done until 2 days before the concert will take place. A withdrawal from a concert during the event is not possible.

Withdrawal from single 1:1 lessons can be made until 1 day before the agreed time.

5. DATA MANAGEMENT

5.1 If you place an order with us, your data will be included in the customer database of Rosenlunds Musik Centrum. We comply with the Personal Data Records Act and will not provide your data to third parties. See our Privacy Statement.

5.2 We respect the privacy of users of the website and ensure confidential handling of your personal data.

5.3 In some cases, we use a mailing list. Each mailing contains instructions on how to remove yourself from this list.

6. WARRANTY AND COMPLIANCE

6.1 Rosenlunds Musik Centrum guarantees that the services comply with the agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations in force on the date of the conclusion of the agreement. However, the results of workshops, lessons, and online lessons, are solely in the hands of the recipient. Regarding its offered services Rosenlunds Musik Centrum acts in all conscience.

7. OFFERS

7.1 Offers are without obligation unless otherwise stated in the offer.

7.2 Upon acceptance of a non-binding offer by the buyer, we reserve the right to revoke or deviate from the offer within 3 working days after receipt of that acceptance.

7.3 Oral commitments only bind Rosenlunds Musik Centrum after they have been explicitly and confirmed in writing.

7.4 Offers from Rosenlunds Musik Centrum do not automatically apply to reorders.

7.5 Rosenlunds Musik Centrum cannot be held to its offer if the customer should have understood that the offer, or any part thereof, contains an obvious mistake or error.

7.6 Additions, changes, and/or further agreements are only effective if agreed upon in writing.

8. AGREEMENT

8.1 An agreement between us and a customer comes into effect after an order has been assessed for feasibility by us.

8.2 Rosenlunds Musik Centrum reserves the right to immediately terminate any entrusted order or assignment, without stating reasons and without being obliged to pay compensation, provided that written notification is given, and without being obliged to pay compensation. The delivered services and the costs incurred up to the delivery of the order or assignment will then be invoiced.

8.3 If the customer terminates or cancels the agreement, or if the agreement cannot be fulfilled due to the customer's actions, the customer will owe us compensation (see further in the cancellation conditions). If a fixed price has been agreed upon and the assignment is terminated by the client during the current year, all services provided by Rosenlunds Musik Centrum during that year will be settled at the hourly rate in effect, with the amounts already invoiced during that year being deducted as advances.

8.4 We reserve the right to not accept orders or assignments without stating reasons, or to only accept them on the condition that the shipment is made cash on delivery or after prepayment.

9. COPYRIGHT

Rosenlunds Musik Centrum retains the copyrights to all works it performs on behalf of the customer and to all products, goods, courses, and texts it provides. The customer undertakes to mention the reference "Rosenlunds Musik Centrum" on every reproduction. The customer is prohibited from modifying the contributions in any way. In the event of any infringement of the copyright, including but not limited to any failure to mention the reference "Rosenlunds Musik Centrum" on any authorized reproduction of a copyrighted work, the customer will owe a lump-sum compensation of 50.000 SEK per infringement and per infringing text/product/course.

10. FORCE MAJEURE

10.1 We are not liable if and to the extent that our obligations cannot be fulfilled due to force majeure.

10.2 Force majeure is understood to mean any foreign cause, as well as any circumstance that should not reasonably be at our risk. Delay or failure by our suppliers, disruptions in the Internet, disruptions in electricity, disruptions in email traffic, disruptions or changes in technology provided by third parties, transportation difficulties, labor strikes, government measures, delays in supply, negligence by suppliers, manufacturers or musicians of Rosenlunds Musik Centrum, as well as by auxiliary persons, sickness of personnel, defects in auxiliary or transport means, are expressly considered force majeure.

10.3 In the event of force majeure, Rosenlunds Musik Centrum reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part or to demand that the content of the agreement be changed in such a way that execution remains possible. In no case are we obliged to pay any fine or compensation.

10.4 If we have already partially fulfilled our obligations upon the occurrence of force majeure, or can only partially fulfill our obligations, we are entitled to separately invoice the delivered or deliverable part, and the customer is obliged to pay this invoice as if it concerned a separate contract.

11. LIABILITY

11.1 The liability and indemnity obligation of Rosenlunds Musik Centrum is always limited to the amount covered by the professional liability insurance taken out by Rosenlunds Musik Centrum and within the limits of the coverage. is not liable for services provided by third parties that it has engaged.

12. APPLICABLE LAW/COMPETENT COURT

13.1 Swedish law applies to all agreements.

13.2 The competent court within the Värmland county has jurisdiction to hear any disputes arising from an agreement between us and the buyer, which cannot be resolved by mutual agreement, unless we prefer to submit the difference to the competent court of the place of residence of the buyer/service requester, with the exception of those disputes that fall under the competence of the justice of the peace of Värmland.

13.3 In the event of disputes with customers who are not consumers, only the justice of the peace or the courts of the district of our registered office have jurisdiction, unless the law prescribes something different.

13. PAYMENT TERMS

14.1 The invoice is payable within 14 days after the invoice date to the following account:

14. CANCELLATION CONDITIONS

15.1 If you need to cancel, the following applies:

• >1 day before the workshop or lesson = 0% of the invoice amount owed.

• < 1 day before the workshop or lesson = 100% of the invoice amount owed.

15.2 Rosenlunds Musik Centrum has the right to cancel workshops, lessons, or concerts or move them to another date, without being liable and without compensation. This will only happen in unforeseen circumstances or situations of force majeure.
